1. Who We Are and Scope
These Terms govern your use of theultimateprofile.com and its services (the "Service"), operated by Nico Jaroszewski, The Ultimate Profile, Schlosstalstrasse 202, 8408 Winterthur, Switzerland, info@theultimateprofile.com ("we", "us"). By creating an account, making a purchase or using a free tool, you agree to these Terms. Our Privacy Policy and Cookie Policy explain how we process personal data.
2. Eligibility and Your Account
- You must be at least 18 years old.
- Give accurate information and keep your login secure. You are responsible for what happens in your account.
- One person per account. Accounts are personal and cannot be transferred.
- If you pay before signing in, we create or link an account for the email address you give, so you can access what you bought.
3. The Service
- We create AI-generated dating profile photos from photos you upload: your Identity Card, photo sets in the shop and, for subscribers, the photo studio and assistant.
- Free offers, such as the free photo, the photo score and the words tool, can have limits (for example one free photo per person, or daily limits) and can be changed or ended at any time.
- AI results vary. Generated photos are AI-made images, not photographs of real moments. They may not look exactly like you, and we do not promise any particular result, number of matches or dating success.
- Example images on our website show the style of results; your photos will differ.
- We use AI providers to create results (see section 7.1 of the Privacy Policy). Available models and features can change.
4. Prices, UP Credits and Payment
- Prices are shown before you pay. The checkout shows the final amount and currency (US dollars, euros, Swiss francs or Polish zloty, depending on your country). We are not registered for VAT, so no VAT is added.
- Payments are processed by Stripe with the payment methods shown at checkout.
- UP Credits are a prepaid in-app currency for unlocking photo sets and paying for renders and other features. They have no cash value, cannot be exchanged for money or transferred, and are not refundable except as stated in sections 6 and 7 or required by law.
- UP Credits do not expire, including after a subscription ends. Features reserved for subscribers need an active plan.
- Bonus credits (for example signup, invite or loyalty rewards) are granted under the conditions shown with the offer and can be removed if they were obtained through abuse or a refunded payment.
- What a photo set includes (for example one render per card) is shown before you buy. Further renders, higher resolutions and other models cost the UP Credits shown before you start them.
- The Starter set offer can be bought once per person and unlocks the set shown with it.
- If a render fails for a technical reason, the UP Credits charged for it are returned, and a failed included render can be retried for free.
5. Subscriptions
- Monthly and yearly plans renew automatically until you cancel. Yearly plans are charged for the full year in advance.
- Each billing period adds the plan's UP Credits to your account.
- You can cancel at any time under Billing in your dashboard. Cancellation takes effect at the end of the period you already paid for and does not refund that period, except as stated in sections 6 and 7.
- We will tell you about price changes in advance. They apply from your next renewal, and you can cancel before then.
6. 30-Day Money-Back Guarantee
We offer a voluntary 30-day money-back guarantee on your first payment: your first subscription payment on any monthly or yearly plan, your first credit-pack purchase, or the one-time Starter set offer. Request a full refund by emailing info@theultimateprofile.com within 30 days of that payment. Renewals are excluded. Credits and sets granted by the refunded payment are removed. Your statutory rights remain unaffected.
7. Right of Withdrawal (Consumers in the EU, EEA and UK)
- If you are a consumer in the EU, the EEA or the UK, you can withdraw from a contract concluded online within 14 days of concluding it, without giving reasons.
- For digital content delivered immediately (UP Credits, photo sets and renders), the right of withdrawal ends when delivery begins, because at checkout you ask us to start immediately and acknowledge that your right of withdrawal ends.
- For subscriptions, if you ask us to start within the withdrawal period and then withdraw, you pay a proportionate amount for what was provided until then.
- To withdraw, send us a clear statement, for example by email to info@theultimateprofile.com. We refund within 14 days using your original payment method.
- Swiss law gives no statutory right of withdrawal for online purchases; the guarantee in section 6 applies.
8. Your Photos and Rules of Use
- Upload only photos of yourself, or photos you have the right and the consent of the people shown to use. Your Identity Card must show you.
- Not allowed: images of minors; nudity or sexual content; illegal, hateful or violent content; images of other people without their consent; impersonating other people or public figures; using results to deceive, defraud or harass anyone; getting around limits, bot checks or security; automated access or scraping; reselling the Service or the generated photos.
- We can refuse or remove content and stop a render that breaks these rules or the safety rules of our AI providers.
- When you use the photos on dating apps or elsewhere, you are responsible for following those platforms' rules, including their rules on AI-generated or edited images, and for presenting yourself honestly.
9. Rights to Content
- You keep all rights to the photos you upload. You allow us to store and process them, and to send them to our providers, only to provide the Service to you and for as long as needed (see section 9 of the Privacy Policy). We do not use your photos to train AI models, and we do not use your photos or results in our marketing without your separate permission.
- You may use the photos generated for you for personal purposes, including dating profiles and social media, worldwide and without time limit. Commercial use, such as advertising, stock photos or resale, needs our written consent. In some countries AI-generated images are not protected by copyright, and others may create similar images.
- The website, the photo sets, their designs and prompts, and our brand remain ours.
10. Invites, Partner Program and Rewards
- Invite links, the partner program and loyalty rewards work under the conditions shown on their pages at the time. Partners must also accept the partner program terms.
- Self-referrals, multiple accounts and other abuse are not allowed and void the rewards.
- We can change or end these programs for the future. Rewards already earned remain.
11. Availability and Changes
- We work to keep the Service available, but we cannot guarantee uninterrupted operation. Maintenance and outages of providers can occur.
- We can improve, change or discontinue features. If we discontinue a paid feature that you paid for and have not used, we offer a fair alternative or refund the unused part.
12. Ending Your Use
- You can stop using the Service at any time and delete your account in Settings. Deleting it erases your photos and generated images, so download what you want to keep first. Deleting the account also cancels an active subscription. Remaining UP Credits are lost and not refunded, unless the law or section 6 requires a refund.
- We can suspend or close an account for serious or repeated breaches of these Terms, fraud, payment abuse or legal reasons. Where reasonable, we warn you first. If we close your account without a breach on your part, we refund unused paid UP Credits and the unused part of a prepaid subscription.
13. Liability
- We are liable without limitation for intent and gross negligence, and wherever mandatory law requires it.
- Otherwise, as far as the law permits, we are not liable for indirect or consequential damage, lost profit, or for results or reactions on dating platforms, and our total liability is limited to the amount you paid us in the 12 months before the claim.
- Mandatory consumer rights remain unaffected.
14. Changes to These Terms
We can update these Terms for a valid reason, such as new features or changes in the law. We inform you of material changes in advance by email or on the website. Changes do not apply to purchases already made. If you do not agree, you can stop using the Service and cancel your subscription before the changes take effect.
15. Governing Law and Disputes
These Terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Winterthur, Switzerland. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and can also bring claims before the courts there. Please contact us first; we try to resolve every issue quickly.
